This Copyright Policy applies to all Customers and Authorized Users and comprises part of the Mural Terms of Service. Any capitalized terms that are not defined in this Copyright Policy have the meaning ascribed to such terms elsewhere in our Terms of Service.

POLICY STATEMENT

Mural respects the intellectual property rights of others and we expect our Customers and their Authorized Users to do the same. It is Mural's policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of Authorized Users or Customers who repeatedly infringe or are repeatedly charged with infringing the copyrights or other intellectual property rights of others.

If any Customer receives a DMCA notice for Content posted through the Services, the Customer will assist Mural by immediately forwarding the notice to our Designated Agent at the contact information below.

PROCEDURE FOR REPORTING CLAIMS OF COPYRIGHT INFRINGEMENT

In accordance with the U.S. Digital Millennium Copyright Act of 1998 (“DMCA”), Mural has a designated agent for receiving notices of copyright infringement and follows the notice and takedown procedures of the DMCA. 

Notice of copyright infringement: If you are a copyright owner or their agent and believe that any Workspace Content or other content on our Services infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit Mural to locate the material;
  • Information reasonably sufficient to permit Mural to contact you, such as an address, telephone number, and, if available, an email address;
  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Please note that, under Section 512(f) of the US Copyright Act, any person who knowingly materially misrepresents that material or activity is infringing (or that material was removed by mistake or misidentification) may be subject to liability for damages. Don't make false claims!

Please also note that the information provided in a notice of copyright infringement may be forwarded to the Workspace Owner. In particular, Mural will provide notice to the Workspace Owner if their Content or any Contribution of one of their Authorized Users has been removed based on a third party complaint of alleged infringement. 

Counter-notice: If you are the Workspace Owner and you believe that the Content that was removed or to which access was disabled is either not infringing, or you believe that you have the right to post and use such Content from the copyright owner, the copyright owner’s agent, or pursuant to the law, you must send a counter-notice containing the following information to the Designated Agent at the address listed below:

  • Your physical or electronic signature;
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
  • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content; and
  • Your name, address, telephone number, and, if available, email address; and
  • A statement that you consent to the jurisdiction of the Federal Courts located in California and that you will accept service of process from the person who provided notification of the alleged infringement. 

If a counter-notice is received by the Designated Agent, Mural may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed Content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Workspace Owner, the removed Content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Mural’s discretion.

It is often difficult to determine if intellectual property rights have been violated or if the DMCA requirements have been met. We may request additional information before we remove any infringing material. If a dispute develops as to the correct owner of the rights in question, we reserve the right to remove the Content in question pending resolution of the matter.
